- The FIRST PARTY will issue a Demand Letter to the SECOND PARTY specifying the number of workers needed, their categories, salaries, and other service conditions. This letter will be accompanied by a Power of Attorney, Guarantee Letter, Inter Party Agreement, and Employment Contract, which authorize the SECOND PARTY to recruit workers from Saudi Arabia on behalf of the FIRST PARTY. Both the Demand Letter and Power of Attorney must be notarized by the Chamber of Commerce and Industry in the employing country, the Foreign Ministry, and the Saudi Arabia Embassy.
- Both parties must secure approval from their respective governments to source, recruit, and supply workers according to the regulations of both countries.
- The SECOND PARTY is responsible for shortlisting candidates based on their trade qualifications and experience to meet the FIRST PARTY's requirements. The SECOND PARTY must inform the FIRST PARTY of the shortlisted candidates who are prepared for final interviews and selection.
- The FIRST PARTY has the option to send a representative or allow the SECOND PARTY to manage the selection process and send the qualified workers under the SECOND PARTY’s full responsibility.
- Workers will be interviewed, tested, and selected by a representative of the employer or by the SECOND PARTY on their behalf. The FIRST PARTY will notify the SECOND PARTY of the final list of selected personnel in writing and provide the desired mobilization date.
- The SECOND PARTY will assist the workers with immigration and government formalities, medical tests, visa stamping from the relevant embassy, and any other necessary approvals.
- The SECOND PARTY will provide airport assistance for the departing workers at their own expense and inform the FIRST PARTY of their arrival details through written or verbal communication, so the FIRST PARTY can receive them at the airport.
- The FIRST PARTY will be responsible for receiving the workers at the airport.
- The workers' monthly earnings and other service conditions will be detailed in the Demand Letter and contract. The FIRST PARTY must clearly communicate the salary and any deductions, such as taxes, to the SECOND PARTY, who will then inform the candidates before mobilization.
- If a worker is found unfit, unqualified, unwilling to work, fails medical tests upon arrival, or is considered a security threat during the three-month probation period, the FIRST PARTY can replace the worker. The SECOND PARTY will handle the replacement within one month of termination and will cover all related expenses.
- Selected workers must arrive within one month of visa issuance. Any delay beyond this period will result in visa cancellation, and the SECOND PARTY will be responsible for all governmental expenses for replacement.
- The FIRST PARTY will compensate the worker if facilities are not provided as per the Employment Contract or if the company fails before the contract ends.
- The FIRST PARTY also agrees to cover compensation in case of death or injury of the workers and the cost of transporting the deceased's body to Saudi Arabia, under the relevant labor laws.
